Completing the Loan Modification Intake Form

The Loan Modification Intake form is how you submit a loan modification to GoDocs.

 What this program covers


Modifications to existing CRE and C&I loans, including:

  • Maturity date extensions
  • Repricing or re-amortization
  • Interest rate or index changes
  • Payment deferrals
  • Extensions of in-term periods
  • Changes to borrowing base provisions, financial covenants, and financial reporting requirements

What it does not cover


  • Adding or removing Borrowers, Guarantors, or Grantors/Mortgagors
  • Changes to recourse
  • Adding or releasing collateral
  • Loan assumptions
  • Modifications requiring a recordable mortgage or deed of trust amendment
  • SBA loans
  • MERS loans
  • Unsecured loans

Formatting rules that apply throughout


  • Dates: enter month/day/year, for example 07/01/2026. We convert entered dates to spelled-out dates in the agreement.
  • Dollar amounts: enter the number only in the format you desire. We add the "$".
  • Enter "N/A" for anything that does not apply, and leave optional items blank.

Section 1 Loan Details


Identifies the loan and sets the key dates.

  • Modification Fee: the non-refundable fee, if any, the Lender must receive as a condition to closing.
  • Effective Date: when the modified terms take effect.
  • Deadline Date: the date the unexecuted package is void.
  • Agreement Date: the date of the agreement, on or before the signing date.
  • Original Loan Date: the date of the original loan documents.
  • Guaranty Date: the date the guaranty was executed. Leave blank if the loan has no guaranty.
  • Outstanding Principal Balance and its "as of" date: enter the balance and the date it is stated as of.

Section 2 Parties


List all current, existing parties to the loan as of now, using full names exactly as they should appear in the documents. Enter N/A for any that do not apply. You can also include notice address or specific ownership information as desired; eg. …, whose address is… or … as to real estate common found at …

  • Borrower Name(s): all parties signing as Borrower.
  • Grantor Name(s): parties that granted a lien on collateral.
  • Guarantor Name(s): all Guarantors. N/A if none.
  • Lender Name: as it will appear in the modification.

Section 2 vs. Section 5: This section is about who is currently on the loan, not who will sign. You choose who actually signs the modification in Section 5.

Section 3 Modified Terms


This is where you describe the actual changes, and it is the part that does the work. Whatever you enter here is reflected verbatim in the Loan Modification Agreement, so the Modification Agreement itself is what carries and effectuates the change. Enter "N/A" if such document is not being modified at this time.

  • Describe each amendment as of the Effective Date, using separate numbered paragraphs.
  • Note: amendments to the Note.
  • Collateral Documents: amendments, if any.
  • Other Loan Documents: amendments, if any.

The change lives in the agreement

You will not receive a redrawn or amended copy of the underlying document. For example, to extend the maturity date, you state in the Note section that the Note is modified to reflect the new maturity date. The Modification Agreement states that change. You do not get a new Note.

Section 4 Notices and Waivers


Check only those that apply.

  • Balloon Payment Notice: the modified terms cause a balloon payment to become due on the Note's maturity date. For lines of credit, the estimated balloon payment could be the entire loan amount.
  • California Prepayment Waiver: California law governs the Note and a prepayment premium or penalty is being modified or added.
  • California Early Cancellation Waiver: California law governs the Note and an early line-of-credit cancellation fee is being modified or added.

Release of Claims waiver, choose one:

  • Non-California Waiver: California law does not govern any Loan Document.
  • California Waiver: California law governs the Note or another Loan Document (includes Civil Code 1542).

Section 5 Signature Blocks


Enter the party name and signatories with capacity for each party that will sign, following the example format. This is where you distinguish who signs the modification from who does not. At a minimum, the Borrower must execute the loan modification.

"(SEAL)" is added or omitted at your discretion.

Provide a signature block for each signing party: Borrower, Guarantor, Grantor, Lender. Mark "N/A" for any party that is not signing.

Section 6 Disbursement and Funding Authorization


We always generate a Disbursement and Funding Authorization with a modification. If yours does not need one, tell us and we will discard it before closing.

Itemize fees across the tables (Description, Paid To, Amount, Paid By):

  • Borrower Fees: Financed
  • Borrower Fees: Paid Outside Closing (POC)
  • Deposits, Payoffs, Holdback, Final Wire

Remaining Fees to be collected from Borrower: the total the borrower must pay. You decide which categories it covers.

Common mistakes to avoid


  • Listing only the signing parties in Section 2. List everyone currently on the loan there, then choose signers in Section 5. The identified parties and the signers of the modification can be different depending on the particulars of your intention.
  • Expecting a new Note or mortgage back. The change lives in the Modification Agreement, not in a reissued original document.
  • Trying to add or remove parties, change collateral, or record a mortgage amendment through this form. Those are out of scope, so ask us for the right path first.
