How does GoDocs handle the New York Section 22 Lien Law Affidavit?

The New York Section 22 Lien Law Affidavit included in our loan doc package is a sample affidavit which may be used for this loan transaction. Customers are welcome to use it in lieu of one provided by the title company or the customer’s legal counsel. That said, should a customer opt to use it, it must first be reviewed, revised, and otherwise completed by the customer following the customer’s consultation with the title company and, if necessary, its legal counsel to ensure all the necessary, correct information required for this loan transaction pursuant to the New York State Lien Law is reflected therein, all before the “Deponent” (the Borrower) executes it. Given the importance of this affidavit, we include a prompt in such applicable orders given the nuances of the New York State Lien Law and how they affect the content of the affidavit.

When using the GoDocs provided affidavit, you will need to fill out the blanks and have the Borrower execute it and have it notarized again. For “fees” and any other dollar figures or other pertinent blanks which need to be filled out prior to its use, it is our understanding that information can be found in either the loan documents or provided by the title company or your legal counsel.
