Since the property is in North Carolina and this property is being refinanced in an individual that is married, the spouse is require by law to sign the Deed of Trust. The non-borrowing, non-owning spouse, will receive a Spousal Waiver and Consent form for the spouse to execute that explains their understanding of the borrowing-and-owning spouse's participation in the loan.
Such consent would appear on the deed of trust signature block for the non-owning spouse to consent to the deed of trust. Please see the example of the signature block for the deed of trust below.
